Terms of Service

Effective date: October 20, 2026

These Terms of Service ("Terms") govern your access to and use of the EcomVision platform (the "Service"), provided by EcomVision Tecnologia Ltda. (Brazilian taxpayer ID CNPJ 47.237.851/0001-16), Rua Bras Pierro, 134, Jardim Nossa Senhora Auxiliadora, Campinas, SP, 13075-510, Brazil ("EcomVision," "we," "us," or "our").

By creating an account, subscribing to a plan, or using the Service, you ("you" or "user") confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company, you represent that you have authority to bind it. If you do not agree, do not use the Service.

1. Definitions

2. The Service

EcomVision is a platform for managing, automating, and optimizing listings, advertising, and profitability for Amazon accounts. With your authorization, it connects to Amazon's official APIs and other services to display metrics and profitability; recommend and — under rules you configure or approve — execute campaign automations; generate and publish listing content with AI assistance; reconcile sales, payouts, and FBA shipments; track inventory; and provide the Vision assistant.

EcomVision is not Amazon, a bank or financial institution, an accountant, or an investment advisor. Information in the Service is provided for informational and decision-support purposes. We may improve, change, or discontinue features, and we will communicate material changes.

3. Eligibility and registration

4. Account, credentials, and security

You are responsible for keeping your credentials confidential and for all activity in your Account. Notify us of any unauthorized use. We may suspend or limit access in case of security risk, fraud, or violation of these Terms.

5. Amazon authorization and compliance

6. Plans, free trial, billing, and cancellation

7. Automations and Artificial Intelligence (Vision)

8. Content and intellectual property

You retain ownership of your content and your account data, and you grant us a limited license to process them solely to operate the Service, as described in the Privacy Policy. The software, interface, the EcomVision brand, and the Vision identity are owned by EcomVision or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service. You may not copy, modify, reverse engineer, resell, or sublicense the Service without authorization.

9. Acceptable use

You agree not to: use the Service for unlawful purposes or in violation of Amazon policies; access data or accounts without authorization; compromise the security or availability of the Service; circumvent technical or plan limits; upload unlawful content or content that infringes third-party rights; or resell access beyond the scope of your plan. Violations may result in suspension or termination.

10. Availability and disclaimers

The Service is provided "as is" and "as available" and depends on third-party data and APIs (especially Amazon's), which may experience outages, delays, or inconsistencies. We work to keep the Service available and accurate, but, to the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not guarantee uninterrupted operation, error-free results, or business outcomes. Business decisions are solely your responsibility.

11. Limitation of liability

To the maximum extent permitted by law, EcomVision is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost revenue, or lost data, or for failures of third-party services (Amazon, banks, payment, AI, connectivity). Our total aggregate liability is limited to the amount you actually paid us in the 12 (twelve) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnification

You agree to indemnify and hold EcomVision harmless from claims and expenses arising from your use of the Service in violation of these Terms or the law, your violation of third-party rights (including Amazon policies), or content or rules you entered or approved.

13. Data protection

Our processing of personal information is governed by our Privacy Policy, which is part of these Terms. You represent that you have the right to direct us to process any third-party data you provide.

14. Term, suspension, and termination

These Terms remain in effect while you use the Service. You may close your Account at any time; we may suspend or terminate access in case of violation, risk, legal requirement, or non-payment, with notice where appropriate. Upon termination, your license to use the Service ends and, subject to the Privacy Policy and legal retention periods, we may delete or de-identify your data — you may request an export before deletion.

15. Changes to these Terms

We may update these Terms. The effective date above indicates the current version; continued use after an update takes effect means you accept it. We will communicate material changes.

16. Governing law and general provisions

You may not assign these Terms without our consent; we may assign them in connection with a corporate reorganization, merger, or acquisition. If any provision is held invalid, the rest remain in effect. Failure to enforce a provision is not a waiver. Neither party is liable for force majeure events. These Terms and the Privacy Policy are the entire agreement regarding the Service.

Governing law and venue: these Terms are governed by the laws of the Federative Republic of Brazil, and the courts of Campinas, State of São Paulo, Brazil, have jurisdiction, except where applicable law requires otherwise.
